Counterfeiting is a global problem for our clients, resulting in lost sales, markets flooded with poor quality imitations, health and safety risks to consumers who purchase counterfeits, and tarnishment of the brand. Our team has a unique range of expertise and a proven track record in handling the enforcement of IP rights against counterfeiters and implementing effective anti-counterfeiting measures based on Japanese intellectual property laws. We are especially skilled in using cease-and-desist orders against counterfeit goods to take advantage of customs authorities’ border control measures. We are also very experienced in leveraging Baker McKenzie’s international network of offices to develop and implement cross-border strategies to address counterfeiting issues.
Representative Experience
- Represented a global electronics company seeking anti-counterfeit action and the imposition of criminal sanctions on sellers of imported counterfeit products before Japanese Customs and the National Police Agency.
- Assisted a major US entertainment company with anti-counterfeiting measures throughout Japan to protect its intellectual property rights and brand image.
- Assisted manufacturers of pharmaceutical products and electronic equipment, among others, in filing, renewing and handling approval proceedings related to import suspensions at customs, checking suspicious cargo, submitting written opinions, coordinating with Customs and submitting written statements in criminal proceedings.
